Table Of Authorities And The Use of Passim
In a previous post of this forum entitled Adding Categories To The TOA, we discussed adding a category to the Table of Authorities when the default list did not accommodate a particular authority type that we needed to mark. It should be noted that when you make changes to the TOA available category listing, it is stored on your particular work station, so if another operator inherits the document and re-runs the TOA on their workstation then then those categories will not be available unless they add them to their work station as well.
In terms of this Article, the selection for Passim comes up within the TOA Dialog Box on the left side.
In our present case, the Latin term “Passim” in this context of a TOA refers to a citation that appears throughout the document a number of times. If “Passim” is checked, and a particular entry is marked five times and above the Passim message will kick in rather than list all of the different pages that the particular citation resides on.
In sum, The term passim should be used in the Table of Authorities only if you cite a particular case or statute on more than five pages throughout the brief. In all other instances, you will use specific page numbers for citations.
I hope this clarifies a minor but important piece of knowledge relating to the creation of a Table of Authorities.
